1) Discuss response to Hyatt NYC letter.

Tom, George, Yvette and Jason to organize as ad hoc committee
1) Respond to Email
2) Pull in John and Alan
3) Tom to send proposed email response to board email exchange today
Intent being to understand our position and potentially reduce the scope of the contract.

We appreciate your quick response to our communication. We would very much like to get on a call with you and Yessenia. Since the participants on our behalf are all volunteers and residing in various areas of the country and world, is it possible for us to target something in the latter part of next week or the early part of the following week so that we can coordinate everybody’s availability?

We are sorry to hear about the request to cancel your May 2021 program. I know both teams worked so hard already to get all the details in place to execute a great conference for next year.
Please be assured that the hotel stands ready and able to host the meeting next year, and we would be open to exploring alternative dates for the group. If neither proceeding with the meeting nor rescheduling is feasible, we will be invoicing you the cancellation fee of $229,795.60. This amount is the difference between what is owed to us based on the contract agreement ($237,895.90) and deducting your deposit on hand ($8,100.30).
At this point it is not impossible or illegal for either party to perform its services in 2021. Force Majeure does not extend indefinitely, it pertains to travel advisories that affect the dates in question or when clients cannot physically make it to a destination. We are currently in a force majeure situation today, however unlikely to be in 13 months from now.
We are here to work together with you, so please let us know if you need anything. Yessenia and I are happy to jump on a call if that is best for all.
