MINUTES OF BOARD MEETING MAY 7, 1987

Meeting opened at 7:30PM with Serenity Prayer.

Minutes of April 30th board meeting were read.

Motion to accept minutes with the following changes; Change F to read: Letter will be sent from WSO to San Francisco Bay Area re: Metal Chips. Motion seconded and carried.

Sobriety date 5-2-85

Will supply board with a resume

OLD BUSINESS

  1. Proposed Budget postponed 5/14/87 merting
  2. Jim B.-Long Beach has resigned from the P.I, Chairperson position. Bob G . was asked to Chair this position.
  3. Mike L. – resigned his position as Director on the Board for personal reasons. Will complete workings already started. Coco will ask Steve P. to replace Mike L.
  4. Linda is still waiting for letter from State Board of Equalization.
  5. Linda brought up issue of new corporation filing. Questioned issues of corporate officers and legal holdings. Explained that there would be duplicate filings of taxes(as each corporation would have to file even though one would not have an income). Ray will address these issues presented to the other Trustees.
  6. The primary purpose of this board is not to place checks and balance on the Trustees.
  7. A letter is forthcoming from Reggie regarding the the Trustees opinion regarding additional committments within the fellowship. This letter will be presented on May 14, 1987.
  8. Coco, at this time, and until the time of conference radification of the Board as is, has the right to replace (remove) any person from the Board
  9. Patty requested a clock at the office and Linda will donate same.

  • Bills Paid – KCT Mfg. $1704.47 (Chips)
  • Businessland 513.00 (Maintenance agreement for computer)
  • Transcript 1319.40 (conference)
  • Transfer $3000 from trust account to operating account
  • Balance $2331.48
  • Deposit 1342.00 (Chips and literature)

Linda has written a letter to receive copy of non-profit status papers.

Meeting with Attorney Bernard Gans (Trademark- Attorney)

  1. Gans was asked to help WSO with Trademark issues by Willie O.
  2. L.A. Chapter was the 1st with the name and Logo.
  3. Rights were transferred from L.A. To WSO.
  4. WSO had to control and license use of name to all our chapters.
  5. Ownership of Literature – Copyright should be applied to all literature distributed among the fellowship. If created by an outside enterprise, must have an assignment issued by them that they assign all rights to us. Present literature not marked all future literature should be, however, the present literature can be marked with stickers.
  6. Trademark- U.S. Service Mark application sent in by Mr. Gans office. We are listed under Association Services. This is a federal trademark application. The application was rejected because of Dr. Baron’s application and N.A.’s application. We must reply by June 23, 1987. Mr. Gans will handle this from his office. We are also waiting to see if NA will file a petition against Dr. Baron or argue that NA & CA are not similar. The federal trademark office is stating that NA & CA are very similar and therefore, our application had been denied as well as the filing by Dr. Baron.
  7. Dr. Baron’s attorney is supposed to issue a letter stating that they will stop application if we do not open up any hospitals for recovery.
  8. WSO asked Mr. Gans to get copies of NA’s file from the Trademark office so that we can prepare our answer for June 23. WSO asked that Mr. Gans write a letter to Dr. Baron requesting that he cancel his registration voluntarily or, as per Mr. Gans, we can and will file a petition to cancel.
  9. Application for LOGO registration to be executed federally. Forms to be submitted at once.

J) Coco asked Mr. Gans about ownership of dyes by manufacturer. She asked how we stood with the manufacturer (present) as far as his, owning the dyes. Can we stop him from using these dyes for someone else? Can we go to another manufacturer for new dyes if we choose? Mr. Gans explained that we can go to any manufacturer we choose and that if we own the Logo, no manufacturer can use if for another client.

K) Mr. Gans suggests that the Bylaws state that any committee member waives right to any literature written.

L) Asked of Mr. Gans – Once we obtain the trademark and ownership of the name, can we stop other corporations from using our name? Mr. Gans explained that only if ther services are similar or used in the public eye, can we stop another corporation from using this name.

M) Re: Copyright – A © can be placed on the literature or the word Copyright and the year can be placed on the literature along with 1st publication or if revised, state so and year of revision, then Cocaine Anonymous World Service, Inc.

The WSO express their gratitude to Mr. Gans for meeting with us.

NEW BUSINESS

  1. Ray spoke about changing the cover letter for the starter kits. He stated that the AA name should be dropped.
  2. Letter regarding”thank you for donations” should be re-instituted with group donations.
  3. Discussion of Cocaine Anonymous 12 Step and 12 Tradition scrolls to be instituted.

The meeting was adjourned at 9:30PM.
